Code Amendment
Description The City's zoning regulations (text and map) are intended to promote the public health, safety, and welfare and can be amended allowing for public input.

Decisionmaker The Planning Commission makes a recommendation and the City Council makes the final decision.

Appeals The City Council's decision can be appealed to the circuit court.

Approval Criteria for Text Amendments Recommendations and decisions on amendments to the text of the MZDO shall be based on consideration of all the following criteria:
  1. Whether the proposed amendment corrects an error or meets the challenge of some changing condition, trend, or fact;
  2. Whether the proposed amendment is consistent with the comprehensive plan and the stated purposes of the MZDO; and
  3. Whether the proposed amendment will protect the health, safety, and general welfare of the public.

Approval Criteria for Map Amendments (Rezoning) The City Council may approve zoning map amendments (rezonings), and the Planning Commission may recommend approval, if the rezoning corrects a technical mistake or the rezoning meets all the following criteria:
  1. The rezoning is consistent with the comprehensive plan and the purposes of the MZDO;
  2. The rezoning will protect public health, safety, and general welfare;
  3. The rezoning is consistent with the stated purpose of the proposed zoning district;
  4. Facilities (including roads and transportation) and services (including water, gas, electricity, police and fire protection, and sewage and waste disposal, as applicable) will be available to serve the subject property while maintaining adequate levels of service to existing development. The applicant shall demonstrate availability of services by providing intent-to-serve letters from the respective service providers with the amendment application;
  5. The rezoning is not likely to result in significant adverse impacts upon other property in the vicinity of the subject tract; and
  6. Future uses on the subject tract will be compatible in scale with uses on other properties in the vicinity of the subject tract.
Application Fee
  • Map Amendment - 1 or 2 lots: $250
  • Map Amendment - 3 or more lots: $250 plus $25 for each lot
  • Map Amendment - Raw Acreage: $250 plus $10 per acre
  • Text Amendment: $250.00
